In late September, a class action lawsuit was filed against DraftKings alleging that the company misled customers about the terms of its $1,000 deposit bonus promotion.
The complaint, filed in New York state court, was brought by plaintiff Neriye Aminov on behalf of himself and other DraftKings customers in the state, and accuses the company of deceptive and unfair business practices related to the marketing of the sign-up bonus.
The lawsuit names three law firms in the class action: Shamis & Gentile, P.A, KalielGold, and Edelsberg Law, representing the plaintiff.
The lawsuit is similar to a December 2023 lawsuit filed by the Institute for Public Health Advocacy in Massachusetts that also challenged the legality of the sign-up bonus.
According to the lawsuit, DraftKings actively advertised a “$1,000 deposit bonus” to attract new users to its sports betting platform.
However, the company allegedly hid the actual requirements for receiving the full bonus in the fine print.
To receive the $1,000 promotion, customers had to immediately deposit $5,000 and then wager at least $25,000 over 90 days on various DraftKings products.
